License Agreement

INTRODUCTION

This software including access to the SUPERFAMILY models, programs and data and any associated documentation whether electronic or printed (hereinafter called "SUPERFAMILY PACKAGE") is made available under a license agreement and may be used only in accordance with the terms of that agreement. This is a legal agreement between you (the Licensee), and the SUPERFAMILY authors. The SUPERFAMILY authors are represented by Julian Gough, University of Bristol, UK. The terms of the license are provided in the following pages.

Academic users are granted a free license upon completion of a registration procedure.

Corporate users are granted a free license upon completion of a registration procedure.

By accessing the SUPERFAMILY PACKAGE itself or completing and sending the registration you demonstrate your agreement to the terms of this license and will become legally bound to the terms therein. Note that access to the SUPERFAMILY PACKAGE is recorded.

It should be emphasized that data provided in or produced by the SUPERFAMILY PACKAGE is by its very nature partly subjective. The SUPERFAMILY authors cannot offer advice on interpretation of the data within the SUPERFAMILY PACKAGE. Any assistance will be strictly limited to attempting to help if there are problems accessing the database with the SUPERFAMILY PACKAGE.

The SUPERFAMILY authors make no representation or warranties with respect to the SUPERFAMILY PACKAGE or any databases accessed through the SUPERFAMILY PACKAGE and specifically disclaims any implied warranties of merchantability and fitness for a particular purpose. The SUPERFAMILY authors reserve the right to revise the software or SUPERFAMILY and to make changes therein from time to time without obligation to notify any person or organisation of such revision or changes. While the SUPERFAMILY authors will make every effort to ensure the accuracy of the SUPERFAMILY PACKAGE neither Julian Gough nor the SUPERFAMILY authors may be held responsible for errors, omissions or other inaccuracies or any consequences thereof.


LICENSE TERMS

DEFINITIONS:

The term "SUPERFAMILY PACKAGE" as used in this Agreement means the hidden Markov model library, associated software, data and any associated documentation whether electronic or printed, together with any updates subsequently supplied by the SUPERFAMILY authors.

This license agreement gives you (the Licensee) certain limited rights to use the SUPERFAMILY PACKAGE. The Licensee does not become the owner of, the SUPERFAMILY authors retain title to all of, the SUPERFAMILY PACKAGE. Licensee assumes responsibility for the selection and use of the SUPERFAMILY PACKAGE to achieve intended results, and for the installation, use and results obtained from the SUPERFAMILY PACKAGE. All rights not specifically granted in this License are expressly reserved by the SUPERFAMILY authors. The SUPERFAMILY authors do not claim title to results obtained with the SUPERFAMILY package.

GRANT OF LICENSE:

The SUPERFAMILY authors grant the Licensee, a non-exclusive license and right to use the SUPERFAMILY PACKAGE, and to access any changes and updates.

WARRANTY:

EXCEPT AS STATED ABOVE, THE LICENSED PROGRAM IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE SUPERFAMILY AUTHORS BE LIABLE FOR LOSS OF PROFIT, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS, INCLUDING BUT NOT LIMITED TO SPECIAL INCIDENTAL CONSEQUENTIAL OR OTHER DAMAGES. LICENSEE WILL NOT HOLD THE SUPERFAMILY AUTHORS OR ITS EMPLOYEES OR AGENTS RESPONSIBLE FOR ANY CONSEQUENCES ARISING FROM LICENSEE'S USE OF THE PACKAGE. LICENSEE WILL HOLD HARMLESS THE SUPERFAMILY AUTHORS FOR ANY LOSSES OR DAMAGES OF WHATSOEVER NATURE ARISING FROM LICENSEE'S USE OF THE SUPERFAMILY PACKAGE.
